These Affiliate Terms (the "Terms") govern participation in the Questo Affiliate Program (the "Program"). By enrolling in the Program, or by accepting these Terms when we ask you to, you (the "Affiliate", "you") agree to be bound by them. These Terms supplement the Questo Creator Terms and the Questo Terms of Use and, in the event of conflict, prevail over them in all matters concerning the Program.
1. Eligibility and enrollment
1.1. Eligibility. The Program is open to users with an account in the Questo Creator Room who are at least 18 years old and have full legal capacity to enter into contracts.
1.2. Enrollment.
(a) If you are a creator, you are automatically enrolled in the Program when a quest you created is first published for sale on questoapp.com (a "Creator Affiliate").
(b) Any other user with a Creator Room account may apply to join the Program from that account. Each application is subject to our approval.
In either case, enrollment requires that you accept these Terms, confirm your email address, and provide or confirm your full name, country and city of residence.
1.3. Approval and verification. We may accept or refuse any application at our sole discretion. We may refuse or end an enrollment where we reasonably suspect a false identity, the use of an email address that is not yours, or abuse of the Program. We may request additional documents, such as an identity card, to verify your identity at enrollment or at any time thereafter.
1.4. Restrictions. The Program is not available where participation, or payment to you, would be prohibited by sanctions or other applicable law, or where our payment providers cannot make payments to you. We may restrict the Program by country at any time.
1.5. Creator Affiliates. If you are a Creator Affiliate, your participation in the Program forms part of your creator agreement with Questo and lasts for as long as that agreement remains in force.
1.6. One Affiliate per person. You may hold only one Affiliate account and one active Code; a Code replaced under Section 2.3 remains linked to the same account. You may not open or use further accounts to obtain additional Codes. Employees of Questo and accounts administered by Questo are not eligible. Where we reasonably believe that several accounts belong to the same person, we may merge or close them and withhold or forfeit the Referral Fees earned through the additional accounts.
1.7. Electronic acceptance. These Terms are concluded electronically. Your acceptance, given by ticking the acceptance box and confirming, has the same legal effect as a handwritten signature. We keep a record of each acceptance, including the version accepted, the date and time, and the IP address and browser used, which constitutes evidence of your acceptance.
2. The Code
2.1. The Code. Each Affiliate is assigned one unique personal referral code (the "Code"), for example "ALEX20". The Code gives customers a 20% discount on the purchase of access to a quest, for themselves or as a gift, at checkout on the Questo website (questoapp.com). It does not apply to passes, quest packs, gift vouchers, events or any other product, and cannot be used in the Questo app.
2.2. Activation. If you are a Creator Affiliate, your Code becomes active once you have accepted these Terms. If you applied, your Code becomes active once we approve your application.
2.3. Choosing and changing the Code. If you apply, you choose your Code when applying; it is reserved for you while your application is pending and assigned to you on approval. If you are a Creator Affiliate, we create your Code from your name (for example "MARIA20"), and you may change it once, to any available combination of 3 to 12 letters and numbers. A replaced Code and the link built on it stop working immediately, but remain linked to your account and are never reassigned; Referral Fees earned with them remain yours.
2.4. Questo branding. No Code may contain, or be confusingly similar to, the Questo name or any other Questo trade mark. The word "Quest" may only be used together with other words (for example, "MAYAQUEST20" is permitted; "QUEST20" is not).
2.5. Personal link and attribution. You also receive a personal link (questoapp.com/r/ followed by your Code). A customer who follows the link has your Code applied at checkout on questoapp.com for 30 days. If the customer follows the links of more than one Affiliate, the Code of the last link followed applies, and a code entered at checkout prevails over any link. A purchase earns a Referral Fee only if your Code is applied to it at checkout. No Referral Fee is due where it is not, including where the customer's browser blocks cookies, the customer uses another device or removes the Code at checkout, and we are not liable for any failure to attribute a purchase to you.
2.6. One discount per purchase. The Code cannot be combined with other coupons, discounts or promotions. Where more than one discount could apply to a purchase, only the most favourable one is applied, and a purchase completed under a discount other than your Code does not earn a Referral Fee.
2.7. Use and ownership. The Code is personal to you, tied to your Questo account and not transferable. You may share it publicly, subject to Section 5. The Code remains the property of Questo, and we may modify the discount, or suspend or deactivate any Code, in accordance with Sections 8 and 9.
3. Referral Fees
3.1. Nature. You provide Questo with independent advertising and marketing services by promoting Questo products to your audience through your Code. In consideration for those services, we pay you the fees set out in this Section (each a "Referral Fee"). Referral Fees do not constitute salary, dividends, royalties or intermediation commissions.
3.2. Standard rate. When a customer uses your Code to buy access to a quest created by someone else, you earn a Referral Fee of 20% of the Net Revenue from that purchase.
3.3. Own-quest rate. When a customer uses your Code to buy access to a quest you created, you earn a Referral Fee of 75% of the Net Revenue from that purchase, in lieu of, and not in addition to, your ordinary creator revenue share for that purchase.
3.4. Net Revenue. "Net Revenue" means the amount actually paid by the customer, after the discount, less any taxes, duties, contributions or levies that Questo is liable to pay or collect on the purchase (including VAT and sales taxes), payment-processing costs, and commissions due to third parties.
3.5. Qualifying purchases. Referral Fees accrue only on genuine, completed and non-refunded purchases. Purchases that are refunded, charged back, cancelled or found to be fraudulent do not earn a Referral Fee, and any amount already credited for them is reversed in accordance with Section 6.2.
3.6. Currency. Referral Fees are calculated in euros. Amounts paid in another currency are converted at the exchange rate published by the National Bank of Romania.
4. Balance, payouts and taxes
4.1. Affiliate balance. Referral Fees from purchases made in a calendar month are allocated to your affiliate balance on the 20th day of the following month. Until then they are shown as pending and cannot be claimed or paid out. Your affiliate balance is held and paid out separately from any creator earnings you may have.
4.2. Claims. Payouts are made on request (a "claim"). You may claim your affiliate balance once (a) it amounts to at least EUR 100; (b) your payout details and the tax information required under Section 4.4 are complete and up to date; and (c) you have provided any documents required of you under Sections 4.5 and 4.6. Claims are processed after the 20th day of the month following the claim. On leaving the Program (Section 8.2), you may claim your balance even if it is below EUR 100, subject to conditions (b) and (c).
4.3. Payment method. Payouts are made in euros, by bank transfer or PayPal, to the account or payout email address you provide with your claim. You are responsible for the accuracy of your payout details; payment made to the details you provided discharges our obligation for that amount. Any fees or currency-conversion charges applied by your bank or payment provider are borne by you.
4.4. Tax information. Before your first payout, and whenever it changes, you must provide accurate tax information: your legal name; your residential or registered address; your country of tax residence; whether you participate as an individual or as a registered business; and your tax identification or VAT number, if you have one. We may suspend payouts while any required information is missing, incomplete or inconsistent.
4.5. Taxes and withholding. All amounts are stated gross of your taxes. You are solely responsible for declaring and paying any taxes and social contributions due on your Program earnings in your jurisdiction. Where the law applicable to Questo requires us to withhold tax from a payment to you, we will withhold it and remit it to the competent tax authority, and the amount withheld discharges our payment obligation to that extent. If you are not a Romanian tax resident, you may benefit from a reduced rate or exemption under an applicable double-taxation treaty by providing a certificate of tax residence, valid for the fiscal year of the payment, with your claim (see questoapp.com/tax-residency-certificate); otherwise, the statutory rate applies. We may report payments made to you to the competent tax authorities where required by law, and you agree to provide the information necessary for such reporting.
4.6. Invoicing. If you participate as a registered business or self-employed person, you must issue Questo an invoice for each claimed amount, referencing these Terms and the services provided, and payment follows receipt of the invoice. If you participate as a private individual, no invoice is required. You must inform us promptly if you are or become registered for VAT and provide your VAT number; where applicable, VAT is accounted for under the reverse-charge mechanism.
4.7. Unclaimed balances. If your balance remains unclaimed for 24 months after we send a written reminder to the email address associated with your Questo account, we may close the balance in accordance with applicable law.
5. Promotion rules
5.1. Compliance. You shall promote the Program honestly and in compliance with all applicable laws and regulations, including those on advertising, consumer protection, data protection and electronic communications, and shall clearly disclose your commercial relationship with Questo wherever you share your Code.
5.2. Prohibited conduct. You shall not:
(a) use your Code, or ask others to use it, for your own purchases or for purchases you fund ("self-referral");
(b) publish your Code on coupon, voucher or deal-aggregation websites, applications or browser extensions;
(c) bid on "Questo" or confusingly similar terms in paid search, or use your Code in advertising that impersonates Questo;
(d) promote your Code through spam, unsolicited messages, cookie stuffing, forced clicks or misleading claims;
(e) represent yourself as an employee, agent or exclusive partner of Questo;
(f) target minors, or use your Code in any unlawful, deceptive or brand-damaging context;
(g) offer or pay any person cash, a rebate, cashback, part of your Referral Fee or any other incentive for using your Code or link;
(h) register or use any domain name, social media account, username or application name that contains, or is confusingly similar to, the Questo name or any other Questo trade mark;
(i) issue any press release or public statement about your relationship with Questo, or describe yourself as an official partner of Questo, without our prior written consent; or
(j) collect payments from customers, or make any promise about refunds, customer support or Questo products on Questo's behalf.
5.3. Contests and giveaways. You are solely responsible for any contest, giveaway or other promotion you run, which must comply with applicable law and with the rules of the platform on which it runs. You may offer access to a quest as a prize only if you have purchased that access yourself, and you may not otherwise offer any Questo product, discount or benefit as a prize.
5.4. Information on request. On our request, you shall tell us where and how you promote your Code, so that we can verify your compliance with these Terms.
5.5. Consequences of breach. A breach of this Section entitles us to withhold or forfeit the Referral Fees concerned, deactivate your Code, terminate your participation, and recover any amounts paid in respect of the breach.
6. Verification and clawback
6.1. Verification. We may audit the use of any Code and may withhold, delay, cap or decline to credit Referral Fees where we reasonably suspect fraud, abuse or a breach of these Terms, pending review. Our records are conclusive as to whether a purchase qualifies, save for manifest error.
6.2. Clawback. If a purchase that earned a Referral Fee is refunded or charged back at any time, the corresponding amount is deducted from your balance. If your balance is insufficient, we may set off the difference against future Referral Fees.
6.3. Disputes about Referral Fees. You must notify us in writing of any discrepancy concerning a purchase or a Referral Fee within 60 days of the purchase appearing in your affiliate account. After that period, the purchase and the Referral Fee shown for it are deemed accepted, save for manifest error.
7. Relationship of the parties and brand license
7.1. Independent contractor. You participate as an independent contractor. Nothing in these Terms creates an employment, agency, partnership or joint-venture relationship. You have no authority to bind Questo or to negotiate or conclude contracts on its behalf.
7.2. Brand license. We grant you a revocable, non-exclusive, non-transferable license to use the Questo name, logo and the promotional materials we provide, solely to promote the Program in accordance with these Terms and any brand guidelines we publish. All goodwill arising from such use inures to Questo. No other intellectual property rights are granted, and the license ends when your participation ends.
7.3. No guarantee. The Program is provided "as available". We make no representation as to the performance of any Code, customer demand or the level of Referral Fees you may earn, and we may change or discontinue features of the Program in accordance with Sections 8 and 9.
7.4. Customers. Customers who purchase through your Code or link are customers of Questo. You acquire no rights to their personal data, and Questo alone is responsible for their purchases, refunds and customer support.
7.5. Confidentiality. You shall keep confidential any non-public information we share with you in connection with the Program, including individual rates, performance data and business information, and use it only for your participation in the Program.
7.6. Featuring Affiliates. With your prior express consent, we may use your name, image and public content to promote the Program, for example by featuring you as an Affiliate. You may withdraw your consent at any time, with effect for the future.
8. Term and termination
8.1. Term. These Terms take effect on your enrollment and remain in force until terminated in accordance with this Section.
8.2. Leaving the Program. If you are a Creator Affiliate, you leave the Program when your creator agreement with Questo ends. Otherwise, you may leave the Program at any time by asking us at care@questoapp.com to deactivate your Code. In either case, accrued and non-forfeited Referral Fees remain payable in accordance with Section 4.
8.3. Suspension and termination by Questo. We may suspend or terminate your participation, or discontinue the Program, on 30 days' notice, or with immediate effect in the event of breach of these Terms, fraud, or where required by law. On termination for our convenience, accrued Referral Fees remain payable; on termination for your material breach, unpaid Referral Fees arising from the breach are forfeited.
8.4. Removal of materials. Within 14 days after your participation ends, you shall remove your Code, your links and any Questo materials from the websites, channels and other materials under your control, and stop using them.
8.5. Survival. Sections 3.5, 4, 6, 7.1, 7.5, 8.4, 9.1, 9.3, 9.4 and 9.5, and any other provision which by its nature is intended to survive, survive the termination of your participation.
9. General provisions
9.1. Limitation of liability. To the maximum extent permitted by law, Questo's aggregate liability arising out of or in connection with the Program is limited to the total Referral Fees paid or payable to you in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect or consequential loss, loss of profit or loss of opportunity. Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for intent or gross negligence.
9.2. Personal data. We process personal data, including the name, country and city you provide under Section 1.2, the record of your acceptance under Section 1.7 and the tax information under Section 4.4, in accordance with the Questo Privacy Policy. Our payment providers process your data as independent controllers under their own terms and privacy policies.
9.3. Indemnity. You shall indemnify and hold Questo harmless against any third-party claims, damages and reasonable costs arising from your promotion of the Code or your participation in the Program in breach of these Terms or applicable law.
9.4. Governing law and jurisdiction. These Terms are governed by Romanian law. Any dispute arising out of or in connection with them is subject to the jurisdiction of the competent courts of Bucharest, Romania, without prejudice to any mandatory provisions of the law of your country of residence.
9.5. Notices. We may send you notices by email to the address associated with your Questo account or through your account. You may send notices to us at care@questoapp.com.
9.6. Amendments. We may amend these Terms, including the Referral Fee rates and the discount, on 30 days' notice. Amendments apply prospectively and do not affect Referral Fees already accrued. Material amendments require your express acceptance; if you do not accept them, your participation ends on their effective date, and accrued, non-forfeited Referral Fees remain payable in accordance with Section 4. Continued participation after the effective date of a non-material amendment constitutes acceptance of it. If you are a Creator Affiliate, accepting material amendments to these Terms forms part of your creator agreement with Questo.
9.7. Assignment. You may not assign or transfer your rights or obligations under these Terms. We may assign them to an affiliated company or to a successor to our business.
9.8. Force majeure. Neither party is liable for any delay or failure to perform its obligations caused by events beyond its reasonable control.
9.9. Entire agreement, severability and waiver. These Terms, together with the documents referred to in them, constitute the entire agreement between you and Questo concerning the Program. If any provision is held invalid or unenforceable, the remaining provisions remain in full force and effect. Our failure or delay in exercising any right does not constitute a waiver of that right.
9.10. Language. These Terms are concluded in English. Any translation is provided for convenience only, and the English version prevails.
