These Affiliate Terms ("Terms") govern participation in the Questo Creator Affiliate Program (the "Program"). By enrolling, you ("Affiliate", "you") agree to these Terms. They supplement — and where they conflict, take precedence over — the Questo Creator Terms and the Questo Terms of Use for matters concerning the Program.
1. Eligibility & enrollment
1.1. The Program is open to registered Questo creators in good standing who are at least 18 years old and legally able to enter contracts.
1.2. Enrollment requires: (a) accepting these Terms; and (b) choosing a personal referral code ("Code"). Providing payout and tax information (Section 4) is not a condition of enrollment, but no payment will be made until it is complete.
1.3. We may accept or refuse any enrollment at our discretion, and may require re-verification at any time.
1.4. The Program is not available where participation, or payment to you, would be prohibited by sanctions or other applicable law, or where our payment processors (Section 4.3) cannot deliver payments. We may restrict availability by country at any time.
2. The Code
2.1. Upon enrollment you receive a unique personal Code (e.g. "ALEX20"). The Code grants eligible customers a 20% discount on their first purchase on questoapp.com (quests, city passes, packs, or gifts), limited to one use per customer.
2.2. The Code is personal to you. You may share it publicly (social media, newsletter, bio, word of mouth), subject to Section 5.
2.3. The Code remains Questo's property. We may modify the discount level, suspend, or deactivate any Code as set out in Section 8.
2.4. The Code is not combinable with other coupons, discounts, or promotions. Where more than one discount could apply to a purchase, only the single most favourable discount is applied. If a purchase is completed under a different discount than your Code, that purchase does not earn a Referral Fee.
3. Referral Fees
3.1. Nature of the fees. You provide Questo independent advertising and marketing services: promoting Questo products to your audience through your Code. The amounts payable under this Section (each a "Referral Fee"; shown as "commission" or "earnings" in the product interface for simplicity) are the consideration for those services. They are not wages, dividends, royalties, or intermediation commissions.
3.2. Standard fee. For each eligible purchase made with your Code, you earn a Referral Fee of 20% of Net Revenue.
3.3. Own-quest rate. Where the purchase is a quest you created, your revenue share for that sale is instead 75% of Net Revenue. This replaces (is not added to) both the standard Referral Fee and your ordinary creator revenue share for that sale. A single sale never earns more than one rate.
3.4. "Net Revenue" means the amount actually paid by the customer (after the discount) less any taxes, fees, duties, contributions or levies that Questo is legally liable to pay or collect on that sale (including VAT/sales taxes), payment-processing costs, and any commissions due to third parties. Referral Fees are calculated on Net Revenue, not on the gross price paid.
3.5. Where your Code is used on another creator's quest, that creator's ordinary revenue share is unaffected (calculated on the discounted Net Revenue); your Referral Fee is borne by Questo.
3.6. Referral Fees accrue only on genuine, completed, non-refunded purchases by eligible new customers. Purchases that are refunded, charged back, cancelled, or found fraudulent do not earn a Referral Fee; any amounts already credited are reversed (Section 6.4).
3.7. We may change Referral Fee rates or the discount prospectively with 30 days' notice. Changes do not affect Referral Fees already earned.
4. Earnings, balance, payouts & taxes
4.1. Referral Fees accrue in your affiliate balance. This balance is separate from any creator earnings (royalties) you may have: the two are distinct income streams, claimed and paid out separately, and are never combined into a single payout.
4.2. Payouts are made on request ("claim"). You may claim your affiliate balance when: (a) it is at least EUR 100 (or equivalent); (b) your payout details and the tax information required under Section 4.4 are complete and current; and (c) you have provided the documentation under Sections 4.5–4.6 that applies to you. Claims are processed after the 20th of the month following the claim.
4.3. Payout method. Payouts are made by bank transfer (including via providers such as Wise) or PayPal, to the account or payout email you provide with your claim. You are responsible for the accuracy of your payout details; payment initiated to the details you provided discharges our payment obligation for that amount. We bear the sending costs of the transfer; fees or currency-conversion costs charged on the receiving side by your provider are yours.
4.4. Tax information. Before your first payout, and whenever the information changes, you must provide accurate: legal name; residential or registered address; country of tax residence; whether you participate as an individual or a registered business; and, if you have one, your tax identification and/or VAT number. We may suspend payouts while required information is missing, incomplete, or inconsistent.
4.5. Taxes; withholding. Amounts are expressed gross of your taxes. You are solely responsible for declaring and paying all taxes and social contributions on your Program earnings in your jurisdiction. Where the law applicable to Questo (including Romanian law) requires us to withhold tax from a payment to you, we will withhold and remit it to the tax authority, and the amount withheld discharges our payment obligation to that extent. If you are not a Romanian tax resident, you can avoid or reduce withholding under an applicable double-taxation treaty by providing a certificate of tax residence, valid for the fiscal year of the payment, together with your claim and before the payment date (see questoapp.com/tax-residency-certificate; one certificate per year covers all your Questo income streams); otherwise the statutory rate applies. As an EU platform, Questo reports seller/creator income to tax authorities where required (including under Council Directive (EU) 2021/514, "DAC7"), and you agree to provide the information needed for such reporting.
4.6. Invoicing. If you participate as a registered business or freelancer, you issue an invoice to Questo for each claimed amount — referencing these Terms, the services provided and the period covered — and payment follows the invoice. If you participate as a private individual, no invoice is required: your payout rests on these Terms, your claim, and the payout statement we provide. You agree to inform us promptly if you are or become VAT-registered, providing your VAT number; where applicable, VAT is accounted for under the reverse-charge mechanism.
4.7. If your balance remains unclaimed for 24 months after we send you a written reminder to your registered email address, we may close the balance in accordance with applicable law.
5. Promotion rules (prohibited conduct)
You must NOT:
- (a) use, or ask others to use, your Code for your own purchases or purchases you fund ("self-referral");
- (b) publish the Code on coupon/deal aggregation sites (e.g. Honey, RetailMeNot) or in browser extensions;
- (c) bid on "Questo" or confusingly similar terms in paid search, or use the Code in ads that impersonate Questo;
- (d) present the Code through spam, unsolicited messaging, cookie-stuffing, forced clicks, or misleading claims (including undisclosed advertising — you must comply with applicable advertising-disclosure rules, e.g. tagging paid/affiliate content);
- (e) suggest you are Questo's employee, agent, or exclusive partner;
- (f) target minors or use the Code in unlawful, deceptive, or brand-damaging contexts.
Breach may result in fee forfeiture, Code revocation, Program termination, and recovery of amounts wrongly paid.
6. Verification, fraud & clawback
6.1. We may audit Code usage and withhold suspicious amounts pending review.
6.2. We determine in good faith, on our records, whether a purchase qualifies (new customer, first purchase, one use) — our records control.
6.3. We may cap, delay, or decline crediting where we reasonably suspect abuse.
6.4. Clawback. If a purchase that earned a Referral Fee is refunded or charged back (at any time), the corresponding credit is deducted from your balance; if your balance is insufficient, we may set off against future earnings.
7. Relationship, brand license & no guarantee
7.1. You are an independent contractor providing advertising and marketing services. Nothing here creates employment, agency, partnership, or joint venture. You have no authority to bind Questo, and you do not negotiate or conclude contracts on Questo's behalf.
7.2. Limited brand license. We grant you a revocable, non-exclusive, non-transferable license to use the Questo name, logo, and promotional materials we provide, solely to promote the Program in accordance with these Terms and any brand guidelines we publish. All goodwill inures to Questo. No other intellectual property rights are granted; the license ends with your participation.
7.3. No guarantee of earnings. The Program is provided "as available". We make no promises about Code performance, customer demand, or the level of Referral Fees you may earn, and we may change or discontinue Program features per Section 8.
8. Term, suspension & termination
8.1. These Terms apply from your enrollment until terminated.
8.2. You may leave the Program at any time (accrued, non-forfeited earnings remain payable per Section 4).
8.3. We may suspend or terminate your participation, or the Program itself, with 30 days' notice — or immediately for breach, fraud, or legal necessity. On termination for our convenience, accrued earnings remain payable; on termination for your material breach, unpaid Referral Fees from infringing activity are forfeited.
9. Liability, data & general
9.1. Limitation of liability. To the maximum extent permitted by law, Questo's aggregate liability arising out of or in connection with the Program is limited to the total Referral Fees paid or payable to you in the 12 months preceding the event giving rise to the claim. We are not liable for indirect or consequential losses, loss of profit, or loss of opportunity. Nothing in these Terms excludes liability that cannot be excluded by law (including for intent or gross negligence).
9.2. Personal data (including the payout and tax information under Section 4.4) is processed by Questo in accordance with the Questo Privacy Policy. Payment delivery is performed through PayPal or Wise, which process your data as independent controllers under their own terms and privacy policies.
9.3. We may amend these Terms with 30 days' notice. Material changes (including Referral Fee rates, payout terms, or prohibited-conduct rules) require your renewed express acceptance before continued participation; if you do not accept, your participation ends at the effective date and accrued, non-forfeited earnings remain payable per Section 4. For non-material changes, continued participation after the effective date constitutes acceptance.
9.4. Governing law: Romania; competent courts of Bucharest, without prejudice to mandatory consumer or local laws applicable to you.
9.5. Indemnification. You will indemnify and hold Questo harmless from third-party claims, damages, and reasonable costs arising from your promotion of the Code or participation in the Program in breach of these Terms or applicable law (including advertising-disclosure and anti-spam rules).
9.6. Language. These Terms are concluded in English. Translations, if any, are provided for convenience only; the English version controls.
